Land Succession Process in Kenya: Understanding Title Deed Succession

Land is one of the most valuable assets families own in Kenya. However, when a landowner passes away, the property cannot automatically be transferred to heirs without following the legal succession process.

What Is Land Succession?

Land succession is the legal process of transferring land ownership from a deceased person to their rightful heirs or beneficiaries. This process ensures that property is distributed according to the deceased person’s will or, if no will exists, according to Kenyan succession laws.

Without completing the succession process, beneficiaries cannot legally sell, transfer, or develop the inherited land.

Step-by-Step Land Succession Process in Kenya


1. Obtain the Death Certificate

The first step is to obtain the official death certificate of the deceased from the Registrar of Births and Deaths.

This document is required for all legal processes related to inheritance.

Other documents that may be required include:

  • Copy of the deceased’s ID

  • Original title deed

  • Identification documents of beneficiaries

  • KRA PIN certificates

  • Any existing will

These documents will be used when filing a succession case.


2. File a Succession Case in Court

The next step is filing a succession petition in court.

This can be done at:

  • The High Court (Family Division), or

  • A Magistrate’s Court depending on the value of the estate.

Two possible applications may be filed:

  • Grant of Probate – if the deceased left a valid will

  • Letters of Administration – if there is no will

The court then publishes a notice in the Kenya Gazette allowing anyone with objections to raise them.


3. Issuance of Grant of Representation

If no objections are raised, the court issues a Grant of Representation, which appoints administrators to manage the deceased’s estate.

This grant gives legal authority to handle the deceased person’s property.


4. Apply for Confirmation of Grant

After the grant is issued, the law requires a waiting period of at least six months before applying for confirmation of the grant.

During confirmation:

  • The court verifies the list of beneficiaries

  • The proposed distribution of assets is reviewed

  • The court approves how the land will be shared

Once confirmed, the administrators are legally allowed to transfer property to the beneficiaries.


5. Transfer the Title Deed

After the grant is confirmed, the next step is transferring the title deed through the Ministry of Lands or the digital Ardhisasa platform.

Required documents typically include:

  • Certificate of Confirmation of Grant

  • Original title deed

  • Death certificate

  • ID copies and KRA PINs of beneficiaries

  • Transmission forms (LRA 39 or LRA 42)

  • Passport photos

  • Proof of stamp duty payment

Once approved, the Lands Registry registers the beneficiaries as the new owners.


6. Issuance of New Title Deed

After registration, the beneficiaries receive a new title deed in their names, officially completing the succession process.

At this point, the land can be legally sold, subdivided, or developed.

How Long Does Land Succession Take in Kenya?

The timeline varies depending on the complexity of the case.

Typical timelines include:

  • Simple uncontested succession: 6–12 months

  • Complex or disputed cases: 1–3 years or more

  • Title transfer after confirmation: about 1–2 months 

Delays may occur due to family disputes, missing documents, or court backlogs.
